TYPES OF CARGO INSURANCE
There are three common types of insurance. They differ in the degree of liability of the insurer. The latter may be held liable:
○ All risks;
○ Only for a specific accident;
○ Only for loss of cargo (except in cases of natural disaster).
The first type of insurance assumes that the insurer reimburses the insured for all losses, except for losses due to nuclear explosions, military operations, natural loss of cargo (for example, shrinkage) or damage associated with poor-quality packaging.
Under the terms of the second and third types of insurance, the insurer indemnifies losses associated with a particular accident: natural disaster, damage to the vehicle, road accident during loading/unloading, etc.
CARGO INSURANCE IN UKRAINE
Ukrainian legislation does not provide for compulsory insurance of goods, including dangerous goods.
According to the law, the liability of the parties to the contract of carriage must be insured.
In the event that during the transportation of cargo there is damage to the environment, health or property of individuals and legal entities through the fault of the consignor, carrier/freight forwarder or consignee, these persons are obliged to compensate for the damage caused.
